By accessing or using BuildModo (the "Service"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.
BuildModo provides an AI-powered platform to generate, host, and maintain custom apps based on your prompts and configuration. We may modify, suspend, or discontinue any part of the Service at any time.
You must be legally able to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
Some features require a paid subscription. If you start a free trial, it will convert to a paid subscription at the end of the 14-day trial period unless you cancel before the trial ends. Subscriptions renew automatically until canceled. You can cancel at any time to avoid future charges.
Fees are billed in advance and are non-refundable except as required by law. You are responsible for applicable taxes. We may change pricing with reasonable notice.
You agree not to misuse the Service. You will not:
You own your content and data you provide to the Service ("Customer Content"). You also own the custom apps generated specifically for you, excluding BuildModo’s underlying platform, templates, and proprietary tooling. BuildModo owns the Service, including all software, interfaces, and brand elements.
You grant BuildModo a limited license to host, process, and use Customer Content to provide the Service. You grant BuildModo the right to use feedback you provide without restriction.
The Service integrates with third-party services such as Shopify and other providers. Your use of those services is subject to their terms and policies. BuildModo is not responsible for third-party services or outages. You agree to comply with the terms and policies of the third-party services that the Service integrates with.
To the extent BuildModo processes personal data on your behalf, you are the data controller and BuildModo is a processor. You agree to comply with applicable privacy laws and obtain any required consents.
Some features may be offered as beta or early access. These features are provided "as is" and may be changed or discontinued without notice.
The Service is provided on an "as is" and "as available" basis. BuildModo disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, BuildModo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or related to the Service will not exceed the amount you paid to BuildModo in the twelve months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless BuildModo and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses arising out of your use of the Service or violation of these Terms.
We may suspend or terminate your account if you breach these Terms. Upon termination, your right to use the Service ends. We may retain and delete data as described in our Privacy Policy.
We may modify these Terms from time to time. We will post the updated Terms and update the "Last updated" date. If changes are material, we will provide reasonable notice.
These Terms are governed by the laws of Greece, without regard to conflict of law principles.
